What is ADR and RID?
ADR is the European agreement on the international carriage of dangerous goods by road, and RID is its equivalent for rail transport. Both legal acts regulate in detail who, how and under what conditions may participate in the transport of hazardous materials – from classification and packaging, through vehicle marking and documentation, to the qualifications of persons involved in carriage.
In Poland, these regulations are implemented primarily through the Act on the Transport of Dangerous Goods (Journal of Laws 2024, item 643), which imposes specific obligations on consignors, carriers, consignees, loaders and packers. The obligation to appoint an ADR/RID Adviser, prepare annual reports and train employees applies to a wide range of entities – not only transport companies, but also manufacturing, medical, pharmaceutical and many other businesses.

Consequences of non-compliance with ADR/RID regulations
The Road Transport Inspectorate and the Office of Rail Transport carry out regular inspections of companies involved in the carriage of dangerous goods. Detected irregularities can have far-reaching consequences – not only financial, but also operational and legal. It is worth knowing exactly what penalties apply for negligence in this area.
Administrative penalties for companies
Under the Act on the Transport of Dangerous Goods, the Road Transport Inspectorate may impose a financial penalty of up to PLN 10,000 per infringement on a company. In the case of repeated or serious violations, penalties may accumulate. Failure to appoint an ADR/RID Adviser, lack of required training or documentation errors are the most common grounds for sanctions.
Penalties for individuals
Liability does not rest solely with the company – regulations provide for penalties for individuals responsible for fulfilling ADR/RID obligations. A fine for a driver or transport manager may amount to PLN 2,000, and in the case of more serious violations – more. Lack of knowledge of the regulations does not exempt from liability.
Suspension of operations and seizure of goods
An ITD inspector has the authority to detain a vehicle or shipment until the irregularities are remedied. In practice, this means delivery delays, frozen goods and the need for immediate action under time pressure. The costs of downtime, repackaging or relabelling often far exceed the cost of prior prevention.
Criminal and civil liability
In the event of an accident or incident involving dangerous goods, law enforcement and courts examine whether the company fulfilled all obligations under ADR/RID regulations. Documented negligence – lack of training, incorrect classification, missing required equipment – may result in criminal liability for managers and compensation claims from injured parties.

Annual ADR/RID Report
The statutory obligation to prepare and submit the annual ADR/RID report, handled entirely remotely by a certified adviser. Fixed rate of PLN 400, deadline managed by us – you send the documents, we take care of the rest.
