BDO is a database on products and packaging, as well as on waste management. The BDO registry, on the other hand, is a list of all entities obligated to register under waste management laws.

The obligation to register in the BDO Registry and maintain waste records and reporting applies to entrepreneurs who: 

  • Generate waste and keep records of these wastes. 
  • Import products into the country in packaging, tires, lubricating oils, vehicles, batteries or accumulators, electrical and electronic equipment. 
  • Produce or import packaging or purchase them in intra-Community transactions (from EU companies). 

Entities listed in Article 50(1) of the Waste Act of December 14, 2012, submit an application for entry into the BDO Registry. According to this article, the decision on whether a company should submit an application to the Registry depends on the scope and extent of its activities in a given area, as well as the quantity and type of waste it produces. 

Areas and scopes for which submitting an application for entry into the BDO Registry is mandatory include: 

Oils, lubricating preparations, pneumatic tires: 

  • Import of products into the country (oils, lubricating preparations, pneumatic tires) 
  • Recycling of waste from products (oils, lubricating preparations, pneumatic tires) 
  • Recovery of waste from products (oils, lubricating preparations, pneumatic tires) 
  • Export and intra-Community delivery of waste from products for recovery or recycling 
  • Recovery organizations 

Vehicles (excluding historical vehicles): 

  • Introduction of vehicles for the first time into the country 
  • Operation of vehicle collection points 
  • Operation of dismantling stations 
  • Operation of shredders 

Electrical and electronic equipment:

  • Introduction of equipment for the first time into the country or authorized representatives
  • Collection of used equipment
  • Processing plant
  • Recycling activity
  • Recovery processes other than recycling
  • Recovery organization for electrical and electronic equipment

Batteries or accumulators:

  • Introduction for the first time into the country of batteries or accumulators
  • Processing facilities for used batteries or accumulators
  • Intermediary entities

  • Packaging recovery organizations 
  • Export of packaging waste and/or intra-Community delivery of packaging waste 
  • Production, export, import of packaging or their intra-Community acquisition or delivery 
  • Recycling or other than recycling recovery processes for packaging waste 
  • Introduction for the first time into the country of products in packaging 
  • Export of products in packaging and/or intra-Community delivery of products in packaging 
  • Economic self-government organizations 

Waste transport: 

  • Waste transport 
  • Waste trading activities 

Waste generation without a permit for waste generation or an integrated permit:

  • Wastes other than those listed in the Regulation of the Minister of Climate of December 23, 2019, on the types and quantities of wastes for which there is no obligation to keep waste records 
  • Wastes in quantities greater than those listed in the Regulation of the Minister of Climate of December 23, 2019, on the types and quantities of wastes for which there is no obligation to keep waste records. 

The Marshal of the voivodeship will enter into the register ex officio an entrepreneur who: 

  • Obtained an integrated permit, 
  • Obtained a permit for waste generation, 
  • Obtained a permit for waste collection or a permit for waste processing, 
  • Obtained a decision approving the program for managing extractive waste, 
  • Or a permit for operating a facility for the disposal of extractive waste, 
  • Obtained a concession for underground storage of waste, 
  • Obtained registration in the register of regulated activities for the collection of municipal waste from property owners. 

Individuals and non-entrepreneurial organizational units who use waste for their own needs.

Entities that own land on which municipal sewage sludge is applied for:

  • Cultivation of plants intended for compost production,
  • Cultivation of plants not intended for consumption and for feed production.

Entities conducting non-professional activities in the collection of packaging waste and waste in the form of used consumer articles, such as medicines and their packaging.

Transporters of waste they generate.

Farmers who are waste producers, managing an area below 75 hectares.

Manufacturing and industrial companies that produce types of waste listed in the Regulation of the Minister of Climate of December 23, 2019, regarding the types and quantities of waste for which there is no obligation to keep waste records, in quantities not exceeding those specified in this regulation, are exempt from the obligation to obtain registration in the BDO Register.
