Legal basis

The obligation to complete periodic training for the OHS service stems from the law:

  • Regulation of the Minister of Economy and Labour of 27 July 2004 on OHS training – form, programme and frequency of periodic training,
  • § 15 of the Regulation – periodic training for the OHS service at least every 5 years,
  • Art. 2373 of the Labour Code – the obligation to train employees in OHS,
  • Annex 1 to the Regulation – the framework periodic-training programme for the OHS service (min. 64 hours).

Periodic training for the OHS service is held at least every 5 years, and the first within 12 months of being hired. Completing postgraduate studies in OHS exempts you from the next periodic training for 5 years.

Frequently asked questions

Under Annex 1 to the Regulation of the Minister of Economy and Labour of 27 July 2004 on OHS training, the training should be organised as a course, a seminar or guided self-study.

In practice you can take it on-site, e.g. at your company, or online (via Zoom, Microsoft Teams or ClickMeeting).

An alternative is e-learning – you get access to a course platform, complete the modules whenever and wherever you like, and finish with a knowledge test.

At least once every 5 years. The first periodic training with a new employer must be completed within one year of being hired.

Under § 17 of the Regulation of the Minister of Economy and Labour of 27 July 2004:

“Completing, within the period referred to in § 15, training, further education or professional development (…) that covers the periodic-training programme required for a given position is deemed equivalent to completing such training.”

As a rule, therefore, periodic training is not required immediately after completing postgraduate studies in OHS. The next periodic training can be held within 5 years of graduation.

The training is organised as a seminar or course based on a detailed programme prepared by the organiser. Framework programme (Annex 1 to the Regulation of 27 July 2004):
