The C&L notification obligation stems from several legal acts:

  • Articles 39 and 40 of the CLP Regulation (1272/2008/EC) – the obligation to notify the classification and labelling of a substance to ECHA,
  • REACH Regulation (1907/2006/EC) – defines substances subject to registration, which affects the C&L notification obligation,
  • the public Classification and Labelling Inventory (C&L Inventory) – the ECHA database where all submitted notifications are recorded,
  • a 30-day deadline from the first placing of the substance on the EU market.

Yes, the C&L (Classification and Labelling) notification is an obligation under the CLP Regulation (1272/2008/EC). Every manufacturer and importer of chemical substances must notify their classification and labelling to the European Chemicals Agency (ECHA). This obligation applies to substances placed on the EU market that are classified as hazardous or are subject to registration under the REACH regulation. For substances placed on the market as part of mixtures, a C&L notification is required if the substance is present in the mixture above certain concentration thresholds, leading to the classification of the whole mixture.

The C&L notification must be made within 30 days of the first placing of the chemical substance on the EU market. Failure to comply with this obligation may result in legal consequences and restrictions on the sale of the substance.

The standard preparation time for a C&L notification is 1 to 2 business days. For more complex cases or a larger number of required notifications, the time is agreed individually with the client. Each C&L notification is validated by the ECHA system almost immediately, meaning the notification becomes active as soon as it is submitted.
