What are the consequences of missing documentation?
The legal and financial consequences of missing required documentation can be severe:
- Administrative fines – Polish Waters authorities may impose penalties for using water without the required water-law permit. Fines range from several thousand to several hundred thousand złoty, depending on the scale of the violation.
- Increased environmental charges – for water abstraction or wastewater discharge without a permit, charges are calculated at 10 times the base rate.
- Suspension of operations – the competent authority may order water use to cease until the legal status is regularised, which in practice means a production standstill.
- Criminal liability – using water without the required permit may result in criminal liability under Art. 476 of the Water Law Act (a fine or restriction of liberty).
- Problems during WIOŚ inspections – missing documentation revealed during a Voivodeship Inspectorate for Environmental Protection inspection results in post-inspection orders and the need to regularise the legal status immediately.
- Blocked building permits – investments requiring water-law matters to be settled will not receive a building permit without the appropriate documentation.
- Risk of liability for damages – in the event of environmental damage, an entity operating without the required documentation bears full responsibility for remediation costs.
