Are you interested in an energy certificate?
On April 28, 2023, new regulations governing the issuance and requirements for energy performance certificates came into effect.
The Energy Performance Certificate (SCE) is a document that provides information about the energy properties and energy efficiency of a building or residential unit. It is mandatory in some countries, including Poland, and serves as a fundamental informational tool for buyers, tenants, and users of buildings.
The SCE is issued based on an energy assessment. This document provides information about the energy consumption of the building, allowing for a comparison of the energy efficiency of different properties.
The energy certificate is valid for a specified period and is required for all newly constructed buildings, renovated buildings, or those involved in real estate transactions – sale or lease. Its goal is to promote construction with lower energy consumption and conscious management of resources.

HOW LONG IS THE ENERGY CERTIFICATE VALID?
The issued energy certificate is valid for 10 years from the moment of its creation or until thermal modernization changes are introduced to the building.
IN WHAT FORM IS THE ENERGY CERTIFICATE PREPARED?
The certificate is produced in both electronic and identical printed versions, sent to the contracting party’s address, following the template outlined in the Regulation of the Minister of Infrastructure and Development.
WHO MUST PLACE A COPY OF THE CERTIFICATE IN A VISIBLE PLACE?
The obligation to place a copy of the certificate in a visible place applies to buildings:
- with a usable area exceeding 500 m2, where services are provided to the public (shopping malls, stations, etc.), if the certificate is already prepared;
- whose usable area occupied by the judiciary, prosecution, and public administration bodies exceeds 250 m2 and where services to clients are provided.
DO ENERGY CERTIFICATES NEED TO BE UPDATED FOR BUILDINGS BUILT BEFORE THE ENFORCEMENT OF THE LAW AMENDMENT?
According to the law from October 7, 2022, energy performance certificates submitted before the effective date of the law remain valid for the period they were prepared.
IS THE ENERGY CERTIFICATE PREPARED FOR A BUILDING OR A UNIT?
When the subject of the sale or lease agreement is a building, the certificate is prepared for the building. However, when the subject of the agreement is a unit, the certificate must be prepared for the unit.
For new buildings from April 28, 2023, the investor is obliged to attach the energy performance certificate of the building to the notification of the completion of the construction or to the application for a permit for use.
