Periodic Occupational Health and Safety (OHS) training must be conducted, and this obligation arises from the law dated June 26, 1974. The Labor Code explicitly addresses this in § 2, article 237(3): “The employer is obligated to provide employee training in the field of safety and occupational health before allowing them to work and to conduct periodic training in this scope.” This applies to every person employed under an employment contract.

There are several possibilities for conducting Periodic Occupational Health and Safety (OHS) training, and the choice largely depends on the nature of the work being performed. Most often, these trainings take the form of instruction, a course, a seminar, or self-directed learning. If you’re still wondering whether periodic Occupational Health and Safety (OHS) training for employers and employees is a necessity, you should know that there are certain rules that must be strictly followed.

First Periodic OHS Training for Employers 

Are you an employer or holding a managerial position in another capacity? You are obligated to undergo your first periodic Occupational Health and Safety training within six months from the start of your employment.

First Periodic Occupational Health and Safety Training for Employees 

Individuals employed in other positions, such as those classified as engineering-technical or manual labor roles, are required to undergo their first periodic Occupational Health and Safety training within 12 months from the start of their employment. 

PERIODIC OCCUPATIONAL HEALTH AND SAFETY TRAINING – FREQUENCY FOR EACH TYPE OF POSITION? 

It is crucial to adhere to the frequency of conducting periodic Occupational Health and Safety (OHS) training. How often should these trainings be organized? As you already know, it depends on the type of position held by an individual and the responsibilities within their scope. 

  • Manual labor positions – periodic OHS training is conducted in the form of instruction, not less than once every 3 years. However, for positions involving particularly hazardous work, the training should occur no less than once a year.

Periodic OHS training should be conducted in the form of a course, seminar, or directed self-education. The following individuals are obligated to participate in the training:

  • employers and other individuals directing employees, such as managers, foremen, and supervisors – not less than once every 5 years;
  • engineering-technical employees, including machine designers, technologists, and production organizers – not less than once every 5 years;
  • occupational Health and Safety service personnel and other individuals performing tasks within this service – not less than once every 5 years.
  • administrative-office employees and others not previously mentioned, whose job nature involves exposure to factors harmful to health, inconvenient, or dangerous, or who have responsibilities in the field of OHS – not less than once every 6 years.

WHEN IS PERIODIC OCCUPATIONAL HEALTH AND SAFETY TRAINING NOT REQUIRED?

The lack of current Periodic Occupational Health and Safety (OHS) training is not a problem for administrative-office employees employed by an employer classified in a professional group with a risk category no higher than the third. Additionally, these individuals may be exempt from participating in the training if they provide the employer with a certificate confirming the completion of the required training during a specific period, for example, with another employer. The condition is that the thematic scope of the training program aligns with the requirements of the new position.

HOW TO OBTAIN A CERTIFICATE OF PERIODIC OCCUPATIONAL HEALTH AND SAFETY TRAINING?

After completing Periodic OHS training, an exam is conducted under the supervision of the training organizer. Upon achieving a positive result, the participant receives a certificate, which simultaneously serves as proof of completing the training. This document should be properly stored along with the personal records of the employed individual.

PERIODIC OHS TRAINING – REGULATIONS AND RESULTING OBLIGATIONS

It is the employer’s obligation to organize Periodic OHS training for employees during working hours. If, for some reason, this is not possible and the training takes place outside working hours, the employee is entitled to appropriate remuneration along with an overtime pay supplement.

The frequency of training is directly determined by regulations, so the employer should be aware that failure to train employees may result in fines being imposed.

WHO CAN CONDUCT PERIODIC OCCUPATIONAL HEALTH AND SAFETY TRAINING?

Periodic Occupational Health and Safety (OHS) training for employers is conducted by organizational units authorized to provide training in the field of safety and occupational health based on the provisions of the Education System Act dated September 7, 1991.

If an employer wishes to perform the tasks of the OHS service in the company and employs up to 10 employees or up to 20 employees and is classified into the activity group for which no higher than the third risk category is determined under the provisions of social insurance for accidents at work and occupational diseases – they must have completed training for employers performing OHS tasks.

REGULATIONS REGARDING TRAINING ISSUES

The main target group for Periodic OHS training planning is employees. However, Article 207 § 3 of the Labor Code indicates that the employer should be familiar with labor protection regulations, including OHS regulations and principles, to the extent necessary to perform their duties. Confirmation is also provided by Article 237(3) § 21 of the Labor Code, which imposes the obligation of undergoing Periodic OHS training for employers.

WHAT DOES THE PERIODIC OHS TRAINING PROGRAM INCLUDE?

The Periodic OHS training program (regardless of the dedicated target group) should include information about:

  • detailed topics;
  • form of implementation;
  • duration of the training.

It is developed by the training unit based on the framework training program provided in the annex to the Regulation of the Minister of Economy and Labor regarding training in the field of safety and occupational health.
