PERIODIC SAFETY TRAINING FOR EMPLOYEES AND EMPLOYERS
When should HSE training for employers be provided, and when for employees?
If you are the employer, or if you are the person in charge of another position – you are obliged to complete the first periodic training within 6 months of starting work.
If you hold another position, such as that of an engineer or worker, you must attend the first training within 12 months of starting work.
INSTRUCTION – A FORM OF PERIODIC TRAINING FOR WORKERS EMPLOYED IN MANUAL POSITIONS
Periodic training for persons employed in worker positions is performed in the form of instruction at least once every 3 years, and in positions where particularly dangerous work is performed at least once a year.
Periodic training in occupational safety and health, conducted in the form of a course, seminar or guided self-study at least once every 5 years should be conducted for:
- employers and other persons managing employees, in particular managers, masters and foremen;
- engineering and technical employees, including designers, constructors of machines and other technical devices, technologists and production organisers;
- employees of occupational health and safety service and other persons performing the tasks of this service.
PERIODICAL OCCUPATIONAL HSE TRAINING FOR ADMINISTRATIVE AND OFFICE WORKERS NOT LESS FREQUENTLY THAN EVERY 6 YEARS
The main audience to think about when planning periodic training in occupational health and safety are employees. However, Art. 207 § 3 of the Labour Code indicates that the employer should know the labour protection regulations, including HSE regulations and rules, to the extent necessary to perform their duties.
This is also confirmed by Art. 2373 § 21 of the Labour Code, which imposes the obligation of periodic HSE training for employers.
Training of employers is conducted by organizational units authorized to conduct training activities in the field of occupational safety and health under the provisions of the Act of 7 September 1991 on the education system.
However, if an employer would like to perform the tasks of safety and health at work service in the company on their own, and at the same time employs up to 10 employees, or employs up to 20 employees if the employer is qualified for a group of activities for which no higher than the third risk category has been established within the meaning of the provisions on social insurance in respect of occupational accidents and diseases, they must have completed a training course for employers performing the tasks of safety and health at work service.
The program of periodic training in occupational safety and health (regardless of the dedicated audience) should include information on detailed topics, form of execution and duration of training. It is prepared by the training unit on the basis of the framework training program included in the appendix to the Regulation of the Minister of Economy and Labour on training in the field of occupational safety and health.
A certificate of completion of periodic safety training is kept in the employee’s personal file.

Choosing a form of self-directed learning – HSE training can be conducted online. Obtaining, updating or complementing the knowledge on occupational safety and health takes place on the basis of materials provided by the training provider. The training materials should be consistent with the issues covered by the training program (e.g. scripts, legal regulations, sets of control questions), as well as adapted to the capabilities of the training participant. Each periodic training in occupational safety and health (also conducted online) should end with an examination, which is conducted by the training organiser.
WHEN CAN AN EMPLOYEE BE EXEMPT FROM PERIODIC TRAINING IN OCCUPATIONAL SAFETY AND HEALTH?
Pursuant to § 2 of Article 237(3) of the Act of 26 June 1974 of the Labour Code: “Training of an employee prior to his/her admission to work is not required in the event that he/she takes up employment in the same position that he/she held with the employer in question immediately prior to the establishment of another employment contract with that employer.”
